If, in connection with your drunk driving arrest, your breath result was .08 or over, or you refused, you must request a hearing within 7 days. If you submitted to a blood draw, you may receive a notice. Ascertain that the address on your ticket is complete and correct, and that DMV has your correct mailing address. The notice, once you receive it, will set forth an effective date and a date by which you must request a hearing. You cannot request this hearing by telephone.
If your BAC is .2 or over or if you have a previous conviction for a drunk driving offense (even DWAI), you are facing jail. I will give you the advice you need to eliminate or minimize that incarceration.
If you have never been contacted by police for drunk driving, know this: You do not have to submit to roadside sobriety tests. You may refuse them, but do so politely. You CAN be sanctioned for refusing to submit to blood or breath testing. If you only submit to a PBT (preliminary breath testing device, usually at the scene), and refuse further blood or breath testing, that is deemed a refusal. It’s not a defense to a refusal that you hadn’t had too much to drink. If you refuse, you will lose your driving privileges for one year, without the possibility of a red, probationary or work license.
