So here is the background info - 6 years ago I was having a bad time financially. And I had too much credit card debt. I defaulted on most of that debt. I then learned an important lesson and now live a cash lifestyle. Most of my old debt was taken over by collection agencies and I settled with them and paid it off.
Then a year ago I was served - I was being sued for the balance of an old debt that was settled with another collection agency. After much research I learned that this is common practice for some bottom feeder, really low life collection agencies. They buy junk debt for pennies on the dollar and try to illegally collect it - violating the Fair Credit Practices Act. I had to hire an attorney; give her a $1000.00 retainer and we sued the collection agency for violating the FCPA. I won but the process took nine months. Nine months to get my money back!
I had one other small credit card debt ($240) that was written off and no collection attempts were made. This debt is over 6 years old and the statute of limitations for collecting on credit card debt in Colorado is 6 years. But I really wasnt too surprised when I started getting collection calls from another junk debt buyer collection agency. It is so common and they prey on the average consumer not knowing collection law and their legal rights. I know collection law from the bullshit I was recently put through.
The collection agency idiots could care less if they are violating the law and have been rude and abusive to me on the phone. Some strange guy has been knocking at my door and at first I thought it could be someone trying to sell something, so I didnt answer. Then he came later at night (9:30) and I am not going to answer the door to some weird stranger. Then 2 nights ago I realized that the weird guy has to be a process server - the bottom feeder collection agency is trying to sue me. The server knocked on my door for 15 minutes (at 9:30 pm) then got verbal: "I know youre home, bitch.", "Do you really want all of your neighbors knowing about your business", "Youre probably a drunk", "Im going to give you 5 minutes to answer or youre going to be in some serious trouble". Really Im going to open my door to this
I know most of you are going to say to just open the door, get served and then hire another attorney. I would win the case but would be out another $1000.00 (for the legal retainer) for many months. And its complete bullshit. I know I was the deadbeat that didnt pay my bill and Ive changed my ways. I am not going to allow myself to be illegally sued again.
Go ahead, flame away. Im not perfect and Ive made my share of mistakes. But I know my legal rights and Im not going to answer my door to some strange guy calling me a bitch.
